Hold Harmless Agreement

Developer: Michael Nicolaro and FinnsMedia
1. Agreement to Hold Harmless
By using the Photo Sheet application (“App”), you agree to indemnify, defend,
and hold harmless Michael Nicolaro and FinnsMedia, its owner(s), affiliates, and partners
from and against any and all claims, liabilities, damages, losses, or expenses arising out of:
- Your use of the App
- Content you upload, create, export, print, or share
- Images, captions, markup, or metadata included in photo sheets
- Use of exported PDFs, printed materials, or emailed documents
2. App-Related Disclaimer
Photo Sheet is a photo organization, labeling, markup, and document creation tool only.
Michael Nicolaro and FinnsMedia are not responsible for:
- Incorrect, incomplete, or inaccurate captions
- Image formatting, layout, export, or printing errors
- Loss of image quality or metadata
- Incorrect use of images or documents created through the App
- Any real-world decisions made based on photo sheets created in the App
All use of the App and any documents created with it is at your own risk.
3. User Content and Communication
You acknowledge that:
- Content is user-generated and may not be verified
- Images, captions, notes, markup, and metadata may be inaccurate or incomplete
Michael Nicolaro and FinnsMedia are not liable for:
- Errors in photo sheets or exported documents
- Incorrect, outdated, or incomplete image details
4. Data and Technology Risks
You agree that Michael Nicolaro and FinnsMedia are not responsible for:
- Data loss or deletion, including temporary storage limits
- Loss of photos, captions, markup, metadata, PDFs, or exported files
- App outages or downtime
- Device compatibility issues
- Network or service interruptions
5. Third-Party Services
The App may use third-party services, such as cloud storage, email, printing, notifications, or platform services.
Michael Nicolaro and FinnsMedia are not responsible for:
- Failures or outages of these services
- Data handling practices of third parties
- Email delivery, printer availability, or cloud storage availability
6. Limitation of Liability
To the maximum extent permitted by law:
Michael Nicolaro and FinnsMedia shall not be liable for any damages,
including but not limited to:
- Data loss
- Loss of photos or documents
- Printing, sharing, or export issues
- Financial loss
- Business interruption
arising from use of the App.
7. Maximum Liability Cap
If liability is imposed, it shall be limited to the amount paid, if any,
by the user to access the App.
8. Acceptance of Risk
By using the App, you acknowledge that:
- You assume all risks associated with creating, storing, exporting, printing, emailing, or sharing photo sheets
- You use the App voluntarily and at your own discretion
