Developer: Michael Nicolaro and FinnsMedia
1. Agreement to Hold Harmless
By using the Pocket Estimate application ("App"), you agree to indemnify, defend,
and hold harmless Michael Nicolaro and FinnsMedia, its owner(s), affiliates, and partners
from and against any and all claims, liabilities, damages, losses, or expenses arising out of:
- Your use of the App
- Content you upload, capture, dictate, or submit including photos, room scans, and damage descriptions
- AI-generated estimates, exposure ranges, or damage assessments produced by the App
- Exported PDF or XLS reports created, shared, printed, or emailed through the App
- Any real-world decisions made based on estimates or reports generated by the App
2. Nature of AI-Generated Estimates
Pocket Estimate uses artificial intelligence to generate property damage exposure ranges
and itemized repair estimates based on user-submitted photos, LiDAR scan data, and
dictated or typed scope notes.
You expressly acknowledge and agree that:
- AI-generated estimates are reference tools only and do not constitute a formal appraisal, inspection, engineering assessment, or insurance determination
- Estimates may be incomplete, inaccurate, or not reflective of actual repair costs in your specific market or circumstances
- No estimate produced by the App should be submitted as a final claim determination without independent review by a licensed professional
- The App does not replace the judgment of a licensed insurance adjuster, contractor, engineer, or appraiser
- Actual repair costs may differ materially from AI-generated estimates due to hidden damage, local market conditions, material availability, or other factors
3. App-Related Disclaimer
Pocket Estimate is a field documentation and AI-assisted estimation tool only.
Michael Nicolaro and FinnsMedia are not responsible for:
- Incorrect, incomplete, or inaccurate damage assessments or cost estimates
- Errors in LiDAR scan data, room measurements, or spatial analysis
- Misidentification of damage type, cause, severity, or scope by the AI
- Image quality, annotation errors, or photo documentation deficiencies
- Export formatting, printing, or file delivery errors
- Any insurance claim decisions, settlements, or disputes arising from use of the App
- Any financial loss resulting from reliance on AI-generated estimates
All use of the App and any documents, estimates, or reports created with it is at your own risk.
4. User Content and Accuracy
You acknowledge that:
- The accuracy of AI-generated estimates depends entirely on the quality and completeness of information you provide
- Photos, room scans, dictated notes, and other inputs may be incomplete, inaccurate, or insufficient to produce a reliable estimate
- The App cannot detect hidden damage, structural issues, hazardous materials, or conditions not visible in submitted photos or captured by LiDAR scanning
- You are solely responsible for the accuracy and completeness of all content submitted to the App
Michael Nicolaro and FinnsMedia are not liable for:
- Estimates based on incomplete, poor quality, or inaccurate user-submitted content
- Errors arising from dictation transcription, voice recognition, or scope description inaccuracies
- Omissions in damage documentation that affect estimate accuracy
5. Professional Licensing Disclaimer
Pocket Estimate is developed with the guidance of an experienced insurance industry
professional. However, the App itself is not a licensed insurance adjuster, appraiser,
contractor, or engineer.
You agree that:
- Use of the App does not substitute for consultation with a licensed professional
- Any estimate produced by the App must be independently verified before use in formal claim, legal, or financial contexts
- FinnsMedia makes no representation that estimates comply with any specific state, local, or carrier requirements for damage assessments
6. Data and Technology Risks
You agree that Michael Nicolaro and FinnsMedia are not responsible for:
- Data loss or deletion, including loss of photos, scan data, notes, or generated estimates
- App outages, downtime, or interruptions in AI processing
- Failures or errors in LiDAR scanning resulting from device limitations or environmental conditions
- Device compatibility issues or iOS version conflicts
- Network or internet interruptions affecting AI analysis
- Loss of exported PDF or XLS files after generation
7. Third-Party Services
The App uses third-party services including Anthropic (AI processing),
Google Firebase (account and usage data), and Apple StoreKit (subscription management).
Michael Nicolaro and FinnsMedia are not responsible for:
- Failures, outages, or errors in third-party AI processing services
- Data handling practices of Anthropic, Google, or Apple
- Changes to third-party services that affect App functionality
- AI model outputs produced by Anthropic's systems
8. Limitation of Liability
To the maximum extent permitted by law:
Michael Nicolaro and FinnsMedia shall not be liable for any damages,
including but not limited to:
- Financial loss arising from reliance on AI-generated estimates
- Insurance claim underpayment or dispute resulting from use of the App
- Loss of photos, scan data, notes, or exported reports
- Business interruption or loss of professional opportunity
- Indirect, incidental, consequential, or punitive damages of any kind
arising from use of the App or reliance on any content it generates.
9. Maximum Liability Cap
If liability is imposed, it shall be limited to the amount paid, if any,
by the user to access or subscribe to the App during the twelve (12) months
preceding the claim.
10. Acceptance of Risk
By using the App, you acknowledge that:
- AI-generated estimates are probabilistic tools and not guaranteed to be accurate
- You assume all risks associated with using AI-generated damage assessments in professional, legal, or financial contexts
- You use the App voluntarily, at your own discretion, and with full awareness of these limitations
- You have had the opportunity to seek independent professional advice before relying on any estimate produced by the App
