Developer: Michael Nicolaro and FinnsMedia

1. Acceptance of Terms

By downloading, accessing, or using the Pocket Estimate application ("App"), you agree to be bound by these Terms of Use. If you do not agree, you must not use the App.

2. Description of Service

Pocket Estimate provides AI-powered property damage assessment tools for insurance adjusters, contractors, and property owners, including but not limited to:

LiDAR room scanning using Apple's RoomPlan framework
Photo capture and annotation with arrows, circles, squares, and highlights
Voice dictation and typed scope-of-damage entry
AI-assisted damage analysis and estimate generation
Low-to-high damage exposure range calculation
Itemized repair estimates organized by room and phase
Automatic photo documentation sheets
Export of reports as PDF or XLS files
Report sharing via email and iOS share destinations

AI-generated estimates are reference tools only. They do not constitute a formal appraisal, inspection, engineering assessment, or insurance determination of any kind.

3. User Responsibilities

You agree to:

Provide accurate, complete, and appropriate content including photos, scan data, and damage descriptions
Use the App in a lawful manner and in compliance with all applicable laws and regulations
Not submit photos, content, or descriptions of illegal activity
Not misrepresent damage conditions, scope, or property information
Review and independently verify all AI-generated estimates before using them in any professional, legal, financial, or insurance context
Not upload harmful, offensive, or illegal material

You are solely responsible for any content you submit, and for any use you make of estimates, reports, or documents generated by the App.

4. Nature of AI-Generated Estimates

You expressly acknowledge and agree that:

Estimates generated by the App are produced by artificial intelligence and are inherently probabilistic — they are not guaranteed to be accurate, complete, or applicable to your specific situation
The accuracy of AI estimates depends on the quality, completeness, and accuracy of the photos, scan data, and notes you provide
The App cannot detect hidden damage, structural deficiencies, hazardous materials, or conditions not visible in submitted content
AI estimates do not replace the professional judgment of a licensed insurance adjuster, contractor, engineer, appraiser, or other qualified professional
No estimate produced by the App should be submitted as a final claim determination, legal document, or professional report without independent review and verification
Actual repair costs may differ materially from AI-generated estimates

5. User-Generated Content

The App allows users to submit photos, LiDAR scan data, voice recordings, typed notes, and other content for AI processing and report generation.

By submitting content, you:

Confirm you have the legal right to submit and use that content
Grant Michael Nicolaro and FinnsMedia a limited license to process such content solely for the purpose of delivering App functionality
Acknowledge that submitted content is transmitted to third-party AI processing services as described in our Privacy Policy

Michael Nicolaro and FinnsMedia do not store your photos, scan data, dictated notes, or AI-generated reports on our servers. All such content is processed in memory and discarded after your estimate is returned.

6. Data Storage and Retention

Photos, LiDAR scan data, dictated notes, and AI-generated estimates are never stored on our servers and are discarded after processing
Only anonymous account and usage data (such as analyses used, subscription tier, and account creation date) is stored in our database
Exported PDF and XLS reports are generated on your device and are your responsibility to retain
Michael Nicolaro and FinnsMedia are not responsible for lost, deleted, or inaccessible exported files

7. Subscription and In-App Purchases

Pocket Estimate includes a free tier with a limited number of analyses
Paid subscriptions are available for unlimited access and are processed through Apple StoreKit
All purchases are subject to Apple's payment terms and refund policies
Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
You may manage or cancel your subscription at any time through your Apple ID settings
FinnsMedia does not process payments directly and is not responsible for billing disputes — contact Apple Support for billing issues

8. Third-Party Services

The App relies on the following third-party services:

Anthropic — AI language model processing for damage analysis and estimate generation
Google Firebase — Cloud database for anonymous account and usage records, and Cloud Functions for backend processing
Apple (iOS / StoreKit / RoomPlan) — App delivery, subscription management, and LiDAR room scanning

Michael Nicolaro and FinnsMedia:

Do not control these services
Are not responsible for their availability, performance, accuracy, or data handling practices
Are not liable for changes to third-party services that affect App functionality

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

Accuracy or reliability of AI-generated estimates
Fitness for use in professional, legal, or insurance contexts
Uninterrupted availability of AI processing or App features
Accuracy of LiDAR scanning results
Compatibility with all iOS devices or versions

10. Limitation of Liability

To the fullest extent permitted by law:

Michael Nicolaro and FinnsMedia shall not be liable for any:

Financial loss arising from reliance on AI-generated estimates
Insurance claim underpayment, dispute, or denial related to use of the App
Indirect, incidental, consequential, or punitive damages of any kind
Loss of photos, scan data, notes, or exported reports
Errors or omissions in AI-generated estimates, exposure ranges, or line items
Business interruption or loss of professional opportunity

If liability is found, it shall not exceed the amount paid by the user, if any, for use of the App during the twelve (12) months preceding the claim.

11. Professional Use Disclaimer

If you are a licensed insurance adjuster, contractor, appraiser, or other professional using this App in the course of your professional duties, you acknowledge that:

You remain solely responsible for the professional quality and accuracy of any work product that incorporates App-generated estimates
App-generated estimates do not satisfy any licensing, regulatory, or professional standards requirements on their own
FinnsMedia assumes no professional liability of any kind in connection with your use of the App

12. Modifications

Michael Nicolaro and FinnsMedia reserve the right to update or modify these Terms at any time. Continued use of the App after any update constitutes acceptance of the revised Terms. Material changes will be communicated within the App or on our website.

13. Termination

We may suspend or terminate access to the App at any time for violations of these Terms, misuse of AI-generated outputs, or for operational reasons, without prior notice.

14. Governing Law

These Terms shall be governed by the laws of the State of New Jersey, United States, without regard to conflict of law principles.
